Abstract
Discusses the Queen's Bench Division ruling in Assimina Maritime Ltd v Pakistan Shipping Corp on the extent to which the Arbitration Act 1996 s.44 may be used to compel "ordinary disclosure" of documents from a non party to arbitration proceedings. Comments on factors likely to prove decisive, including the importance of the requests being sufficiently specific, and notes the alternative arguments for the production of documents raised under s.43 of the Act.
