Abstract
Notes a New Zealand court's decision in Commerce Commission v Rogers on whether an ophthalmologist, his colleagues and the Ophthalmological Society of New Zealand had entered into an arrangement or understanding having the purpose or effect of substantially lessening competition in the cataract surgery market in Southland, contrary to the Commerce Act 1986 s.27, by colluding to prevent any other ophthalmologist from working in the area. Views the case as a warning to professionals.
