Abstract
Comments on the European Court of Justice ruling in MasterCard Inc v European Commission (C-382/12 P) on whether multilateral interchange fees for card payments contravened EU competition law, and the Draft Regulation which proposes to cap fees. Criticises the proposal for allowing merchants to benefit unduly from accepting card payments, at the expense of consumers who will pay higher fees to issuers. Examines the merchant indifference test applied by the Commission.
