Abstract
Reports on the Employment Appeal Tribunal ruling in Gayle v Sandwell and West Birmingham Hospitals NHS Trust on whether the issuing of a final warning by the NHS Trust to one of its employees, after she failed to comply with a management request to discuss time off for her trade union activities, could be classed as a detriment to her. Considers whether the initiation of a disciplinary procedure constituted victimisation under the Race Relations Act 1976.
