Reports on the Commercial Court decision in Associated British Ports (A company created by statute) v Ferryways NV on whether a letter agreement committing Ferryways NV to ensuring that another company in the group fulfilled its obligations to pay handling charges relating to ferry services created a primary or secondary obligation, and whether subsequent variations to the guarantee, to which the guarantor did not consent, discharged it from liability.
