이 연구는 「경찰법」상 국가경찰위원회의 실질화를 통하여 정치적 중립성을 확보하여 경찰권을 민주적으로 통제할 수 있도록 하고 국가경찰사무를 수행하는 경찰의 직무집행을 실질적으로 감독할 수 있게 하기 위하여 국가경찰위원회의 실질화 방안을 모색하고 국가경찰위원회의 민주성과 전문성을 확보하기 위한 개선방안을 제시하고 있다. 국가경찰위원회가 제도적 취지에 맞게 운영될 수 있는 실질적인 방안으로는 첫째, 중앙행정기관으로서의 국가경찰위원회를 합의제 행정기관으로 명확히 규정하여 법적 지위를 확보하고, 둘째, 국가경찰위원의 추천 주체의 다변화를 통하여 민주성을 확장하며, 셋째, 국가경찰위원회 소속의 사무기구를 설치하여 경찰청으로부터의 독립성과 정책개발의 전문성을 향상시켜야 한다는 것을 제시하였다.
This study suggests that political neutrality should be secured through the realization of the National Police Commission under the Police Act, democratic control of police power, and improvement measures to secure democracy and expertise of the National Police Commission in order to substantially supervise the execution of duties of police performing national police affairs. As for the practicalization of the National Police Commission, first, the National Police Commission should secure its legal status as a central administrative agency, a consensus-based administrative agency, and second, expand democracy by diversifying the way the National Police Commission appoints members, and third, it is suggested that the National Police Commission should establish a secretariat to improve independence and policy development expertise from the National Police Agency.
