난민수용국 내에서 건강권을 비롯한 난민의 인권을 보호하고 증진시키는 조건은 무엇일까? 위의 질문에 답하기 위해 본 연구는 말레이시아의 도심난민을 사례로 보호의 사각지대에 놓인 난민들의 건강할 권리가 어떻게 보장되고 있는지 분석한다. 2022년 7월과 2023년 4월 두 차례 말레이시아 쿠알라룸푸르에서 수행된 현지조사를 기반으로, 본 논문은 말레이시아에서 난민들의 건강권 향상을 위한 국제기구나 시민단체들의 역할도 중요하지만, 난민주도조직의 도움 없이는 이들이 운영하는 난민보호프로그램은 불완전하며 효과적이지 못하다고 주장한다. 난민주도조직은 같은 언어·종교·민족 및 문화적 배경과 모국으로부터의 폭력과 피난이라는 공동의 경험을 바탕으로, 난민들이 당면한 문제를 스스로 해결해 나가기 위한 집단행동을 도모하는 중요한 만남의 공간이자 다양한 형태의 권리 옹호 활동이 이루어지는 공간이다. 이들은 특히, 국제난민법 비당사국에서 불법체류자로서의 한계를 극복하기 위해 국제기구 및 시민단체들과 협력하며 삼각협력 파트너십 구축을 도모함으로써, 난민들의 건강권을 보장하는 프로그램들이 성공적으로 운영될 수 있도록 돕는 중요한 중개자 및 정책 촉진자, 사회적 자본으로서의 역할을 다하고 있다.
Under what conditions, do the refugees’ rights to health improve, particularly in the states that are not a party to the Refugee Convention? To answer the question, this article analyzes the situation of refugees in Malaysia with the data gained from field research conducted in Kuala Lumpur, Malaysia in July 2022 and April 2023. This article argues that refugee-led community organizations (RLOs) are the critical policy actors that complement and advance the refugee health and medical programs operated by IOs and NGOs in Malaysia. RLOs take collective actions to solve the refugee issues independently with better knowledge and understanding of the refugee situations derived from the same language, religion, ethnicity, and shared experience of persecution from the country of origin. As a significant social capital, RLOs play a role as mediators and facilitators at the center of a three-tier partnership with IOs and NGOs to improve the refugee protection programs in Malaysia.
