Abstract
중국의 중재사업은 오늘까지 벌써 육십년이 넘었다. 뉴욕협약 가입 한 이십년이 넘었다. 이 발전 역사 중에서 중국법원에서 승인과 집행의 국제상사중재 사건수가가 좋은 결과를 받았다. 중국도 발전 중에서 경험을 쌓고 문제를 잘 발견하고 법규 완화를 되었습니다. 본 논문은 중국 국제상사중재의 중재판정 집행 활용을 정확히 파악하고, 대처할 수 있기 위한 방법의 중국 국제상사중재제도에서는 중재판정의 승인 및 집행 적용되는 중국 중재법, 중국 민사소송법, 뉴욕협약 등 규정은 제정에 힘을 기울이고 있다. 본 논문은 총5장으로 구성되었으며, 주로 내용은 다음과 같다. 제1장 서론에서는 연구의 배경 및 목적, 연구의 범위 및 방법에 대하여 설명하고, 제2장에서는 관련 이론을 서술하였으며 국제상사중재제도의 의의 및 특성을 설명하였다. 제3장에서는 중국의 상사중재제도에 관한 이론적 배경을 살펴보았다. 즉, 중국의 상사중재연혁, 상사중재기구와 중재인, 상사중재에 관한 법규 및 상사중재 분쟁현황을 살펴보았다. 그리고 제4장에서는 중국 국제상사중재판정의 승인, 집행규정 및 관련사례들을 분석하였다. 마지막으로 제5장 결론에서는 본 논문의 내용을 요약하여 중국국제상사중재의 문제점과 향후 개선방안들을 제시하였다. 본 논문은 중국국제상사중재제도에 관한 중재판정의 집행 사례를 살펴봄으로써 문제점과 개선방안을 제시하여 중국의 판정 집행 활용을 정확히 파악하고 대처할 수 있도록 한다.
The arbitration system of China has already existed for more than sixty years. It has been a member of the New York Convention for over twenty years. This thesis examines the recognition and enforcement of foreign awards in the international arbitration system in China. Therefore, this thesis focuses on Chinese arbitration law, Chinese codes of civil procedure, and that in New York, and looks at books, theses, academic papers and cases relates to the recognition and enforcement of foreign awards in the international arbitration system in China. This thesis consists of five chapters as follows. Chapter 1 focuses on research background and the purpose of the thesis including the research scope and method. Chapter 2 explains relevant theories and the importance and characteristics of the arbitration system in China. Chapter 3 observes the theoretical background for the international commercial arbitration system of China. In other words, it observes the history of commercial arbitration in China, commercial arbitration organizations and arbitrators, regulations for commercial arbitration, and the conflict status of commercial arbitration. Chapter 4 analyzed Chinese international commercial arbitration judgment approvals, enforcement regulations, and related cases. Lastly, the conclusion in Chapter 5 sums up the contents of this thesis and presents problems of Chinese international commercial arbitration and future improvement methods. This thesis observes enforcement cases of arbitration judgments regarding international commercial arbitration in China while presenting problems and improvement methods to accurately investigate Chinese judgement enforcement applications and to handle them correctly.
