Abstract
Considers the Court of Appeal judgment in R. v Moore (Peter Oliver) (Costs) on: (1) whether the Court of Appeal could review an earlier decision which included an order to pay the appellant's costs out of central funds; (2) whether the Administration of Justice Act 1960 s.13(3) conferred the power on the court to make such an order; and (3) if not, whether the European Convention on Human Rights 1950 Art.6 was engaged in terms of the making or non making of the costs orders so that s.13(3) should be read down under the Human Rights Act 1998 s.3 so as to be compatible with Art.6.
