Abstract
Comments on British Amateur Gymnastics Association v UK Gymnastics Ltd (IPEC) on whether use of the word and logo signs "UK Gymnastics" infringed BRITISH GYMNASTICS trade marks under the Trade Marks Act 1994 ss.10(2)(b) and 10(3), and constituted passing off. Details the court's review of the similarities of the goods and signs involved, the likelihood of confusion and whether the defendants' sign intended to take unfair advantage.
