Abstract
Looks at the European Court of Justice ruling in Directmedia Publishing GmbH v Albert-Ludwigs-Universitat Freiburg (C-304/07) that, for the purposes of a protected database's infringement, the "extraction" of data should be given a wide interpretation under Directive 96/9 (Database Directive), and setting out factors that were irrelevant in determining whether there had been extraction, including the method used in appropriating data and the fact that it had been individually assessed. Notes the significance of the case for businesses producing and owning protectable databases.
