Abstract
Presents a comparative analysis of the distinction between debt and equity in domestic and international tax law. Compares the classification of relevant financial instruments in Germany, Brazil, Greece, France, the UK, Austria, Switzerland, Holland and the US, and examines their tax policy justifications for the distinction between debt and equity in partnership law, contract law and company law. Reviews relevant international tax issues, including operation of the distinction under the OECD Model Tax Convention, and explains why uniform criteria for the debt/equity distinction are required.
