Abstract
Comments on the High Court of the Justiciary decision in Clark v HM Advocate on whether, for the purposes of sentencing, the Court's full bench judgment in Webster v Dominick expunged the offence of shameless indecency from the common law, thus repealing the reference to the crime in the lists in the Criminal Procedure (Scotland) Act 1995 and the Sexual Offences Act 2003.
