Abstract
Discusses the extent of division in the legal community about the need for reform of the UK's insolvency and restructuring regime. Considers key features of the UK regime, highlighting, by way of example, its advantages over the German system, concerns regarding changes proposed by the European High Yield Association (EHYA), problems arising in connection with the reforms to Spanish insolvency law, the likelihood of Europe-wide harmonisation, and the potential impact of the introduction in the UK of aspects of the US Chapter 11 system.
