Abstract
Notes the General Court judgment in Opko Ireland Global Holdings Ltd v EUIPO (T-88/16) on whether the proposed mark ALPHAREN for pharmaceuticals should not be registered because of similarity to the earlier Hungarian mark ALPHA D3 for pharmaceuticals and likelihood of confusion. Considers the level of attentiveness of kidney patients and health professionals, and low degree of similarity between the marks.
