Abstract
Comments on R. v Shaikh (Safiyyah) (CA) on whether, in the context of terrorist offences, the Powers of Criminal Courts (Sentencing) Act 2000 s.82A required the minimum term of a life sentence to reflect the release provisions relating to determinate and extended sentences, and the extent to which a judge could depart from the usual rule of setting a minimum term of one half of the notional determinate term, as a matter of sentencing discretion.
