Abstract
Comments on the ECJ ruling in Ostas celtnieks SIA v Talsu novada pasvaldiba (C-234/14) on whether Directive 2004/18 arts 47(2) and 48(3) permitted contracting authorities to impose special conditions on operators intending to rely on third parties for the performance of the contract, such as the conclusion of a co-operation agreement or the formation of a partnership.
