Abstract
Comments on R. (on the application of Gardner) v Secretary of State for Health and Social Care (DC) that government policy decisions in March and April 2020, which allowed elderly patients to be discharged from hospital and admitted to care homes, were unlawful as they failed to take account of the known risk of the asymptomatic transmission of the COVID-19 virus, and considers the implications for the forthcoming COVID-19 public inquiry.
