Abstract
Discusses the Queen's Bench Division ruling in Webster v Ridgeway Foundation School on whether, where a pupil was severely injured by youths who did not attend the same school, a duty was owed by the school in respect of keeping the victim safe whilst on the school premises. Outlines the claims made against the school in respect of: (1) the security of its premises: (2) discipline, in particular with respect to racial tension: (3) its responsibly to protect the injured pupil; and (4) its obligations under the Human Rights Act 1998. Discusses the insurers decision to defend the claim in full rather than settle before trial.
