Abstract
Notes the Court of Appeal decision in Socimer International Bank Ltd (In Liquidation) v Standard Bank London Ltd (No.2) on whether a bank's valuation obligation under a forward sale agreement required it to make an objective inquiry into the true market value of the assets concerned or imposed only a duty of reasonable care. Details the court's review of: (1) the limitations on the decision maker's freedom in such circumstances; and (2) what was to happen if the contractual discretion was not exercised when it should have been.
