Abstract
Comments on the European Court of Justice ruling in Criminal Proceedings against Van de Walle (C-1/03) on whether the accidental spillage of hydrocarbons, which caused soil and groundwater contamination, constituted waste under Council Directive 75/442. Considers the wider implications of the judgment such as the possible redundancy of the Environmental Protection Act 1990 Part IIA, the application of Council Directive 75/442 and the need to subordinate the waste objectives of the Environmental Protection Act 1990 Part IIA, and the interaction between Council Directive 75/442 and other regimes such as Council Directive 80/68.
