Abstract
Discusses the strict criminal liability for insider trading in India, including when innocent parties trade on the basis of information that they did not know was unpublished. Reviews the operation of insider trading, the principle of an innocent tippee, and uncertainty over whether a defence of innocent recipient is available. Considers how Canada, France, the US and the EU address the issue, and the lessons they offer India.
