Abstract
This, the first part of a two part article, highlights the growing significance of corporate document retention policies following the Enron scandal and the Supreme Court of Victoria's ruling in McCabe v British American Tobacco. Outlines the legal issues to be considered when implementing a document retention strategy, including data protection concerns under European Parliament and Council Directive 95/46 and the regulation of electronic document storage. Includes a lengthy table detailing key elements of the relevant law in Ireland, Italy, Germany, Norway and the Netherlands.
