Abstract
Discusses the European Court of Justice ruling in Commission of the European Communities v United Kingdom (C466/98) on whether the Community had exclusive competence under the EC Treaty Art.80(2) to make agreements with third countries concerning access to the market for airline services. Considers the legality of bilateral open skies agreements with the United States. Examines the Commission's arguments about the Community's external competence and the effect of the bilateral agreements on freedom of establishment in the Community. Reviews subsequent developments, including the grant of a mandate to the Commission to negotiate an agreement between the European Union and the US, and the changing attitude of the US Government towards the prospect of a single European agreement.
