Abstract
Examines the Supreme Court decision in Cheshire West and Chester Council v P on whether persons suffering from a serious disability, which meant that they could not go out without supervision, and who lacked capacity, were deprived of their liberty as a consequence of their disability such that deprivation of liberty safeguards applied. Outlines the consequences of the court's decision and the implications for planned reform in Ireland.
