Abstract
The Federal Energy Regulatory Commission (FERC) established discovery rules applicable to adjudicatory proceedings in 1984 in response to a call to codify procedures in order to expedite rate case, abandonment, and other selected hearings. The author discusses the basic principles of discovery practice, describes their application in Commission practice, and explains how the new rules differ in some respects from historical practice. He concludes that the Commission is to be commended for adopting formal discovery rules even though no set of rules can eliminate all discovery disputes. What has been accomplished is to give participants a fair set of ground rules under which to operate.
