Abstract
우리나라에서는 탐정 관련 법률이 16대 국회부터 지속적으로 발의되었지만 여러 가지 이유로 제정되지 못하면서 탐정산업의 발전을 가로 막는 장애요인으로 작용하였다. 하지만 2018년 헌법재판소의 결정과 2020년 신용정보업법의 개정으로 인해 국내에서 탐정의 명칭 사용이 가능하게 되었고, 탐정활동의 업무범위가 확대되었다. 이로 인해 21대 국회에 들어 탐정업에 관한 입법의 움직임이 활발해지고 있다. 이에 본 논문에서는 이미 탐정제도가 정착된 미국, 일본, 유럽 국가들의 제도와 법률을 중심으로 우리나라에 도입 가능한 탐정 관리 법률의 방향성을 모색하고자 하였다. 선행연구 및 외국의 법제의 비교 분석에 따르면, 우리나라의 탐정제도는 국가공인제도 보다는 탐정자격관리제도 방식을 도입하는 것이 바람직하다고 사료된다. 다만, 탐정업이 국내에서 하루속히 정착하도록 하기 위해서는 현재 행하여지고 있는 불법적인 탐정활동을 차단함과 동시에 다른 전문자격 영역과의 충돌을 방지할 것이 요청된다. 따라서 탐정업의 법제화에 있어서는 탐정업 부적격자들의 탐정업에로의 유입을 막을 장치가 마련되어야 한다. 또한 탐정업이 다른 전문영역의 직업군(변호사, 법무사 등)과 업무상 상호 충돌이 발생하지 않도록 업무의 영역을 명확하게 설정하여야 할 것이다. 그리고 탐정업의 효율적 이용을 담보할 수 있도록 탐정관련법률에서는 의뢰인들의 피해를 최소화할 수 있는 안전장치를 마련할 필요가 있다.
In Korea, detective-related laws were continuously proposed from the 16th National Assembly, but were not enacted for various reasons, which served as a barrier to the development of the detective industry. However, the decision of the Constitutional Court in 2018 and the revision of 「Crdit Information Use and Protection Act」 in 2020 allowed the use of detective names in Korea, and the scope of detective activities was expanded. As a result, legislation on the detective business has become more active in the 21st National Assembly. Therefore, in this paper, the direction of the detective management act was to be introduced to Korea, focusing on the systems and laws of the United States, Japan, and European countries where the detective system has already been established. According to a comparative analysis of prior research and foreign legislation, it is considered desirable for Korea's detective system to introduce the detective qualification management system rather than the state-authorized system. However, in order to ensure that the detective business is settled in Korea as soon as possible, it is requested to block illegal detective activities currently being conducted while preventing conflicts with other professional qualification areas. Therefore, there should be a mechanism to prevent the inflow of unqualified detectives into the detective business in order to legislate the detective business. In addition, the area of detective’s work should be clearly established so that the detective work does not conflict with other professional occupational groups (lawyers etc.). In addition, detective-related laws need to provide safeguards to minimize client damage to ensure efficient use of the detective industry.
