2022년 교육부 민주시민교육과 폐지와 2023년 대전과 울산의 학교민주시민교육 조례폐지에 보인 정치 사정 변화의 영향을 논의의 계기로 삼아, 초·중등학교 민주시민교육을 규율하는 우리나라 현행 법규 문서들의 의미 연관 분석을 통해서, 그 규범들의 체계 구조적 타당성을 따져보고, 그 미흡한 점을 지적하면서 대안을 제시한다. 먼저 우리나라 현행법상 초·중등학교 교육 일반에 대한 수권의 내용과 구조를 파악한 다음, 초·중등학교 민주시민교육에 대한 법적 규율의 현황을 정리·요약해서 보고, 이른바 ‘국가교육과정’의 초·중등학교 민주시민교육 취급 방식과 내용 및 그 배경 요소들을 살펴 따지면서 나름의 대안을 제시한다. 결론으로는, 초·중등학교 민주시민교육의 정치적 중립성 확보와 충실화를 위해서, <교육기본법>상 교육 이념을 재정립하고 ‘국가교육과정’상 교육 주제·과목을 재설정·재배치하며 학교 교육을 향해 특별한 주문을 하는 각종 특별법들을 재정비할 필요가 있음을 주장한다. 그 재설정·재배치 방향으로는 민주시민교육의 내용 요소들을 될 수 있는 만큼 도덕과와 사회과의 공통 과목으로 집약함으로써 전문성과 보편성을 강화할 것을 제시한다.
This article critically examines the current status of South Korean legal regulations on the ‘Democratic Citizenship Education’ in elementary and secondary schools including the so-called 'National Curriculum' and presents its own alternative. The main points of the alternative is redefining the educational ideals prescribed by the ‘Basics of Education Act’, resetting and rearranging educational topics and subjects included in the ‘National Curriculum’, and reorganizing various special laws that place special orders on school education. As to the direction of reset and rearrangement, the author proposes to strengthen expertise and universality of democratic citizenship education by concentrating the content elements into common subjects of moral and social studies as much as possible.
