연구 목적: 가정 내 노인학대가 지속적으로 발생하는 현실을 반영하여 아들이 고령의 어머니를 폭행한 사건에서 가정폭력범죄 적용에 관하여 분석하고 법ㆍ제도적 미비점을 규명함으로써 노인의 안전한 삶을 담보하고 가정의 평화와 안정을 회복하는데 필요한 기초자료를 제공하고자 하였다. 연구 방법: 주거지에서 아들에 의한 고령의 어머니 폭행에 대하여 보호처분을 청구한 사건의 판례를 살펴보고, 노인복지법으로 의율된 노인학대 사건에 대해 가정폭력범죄 적용을 규명하였다. 연구 내용: 본 사건에서 노인에 대한 폭행 또는 상해 금지규정 위반으로 인한 노인복지법 위반죄가 가정폭력처벌법 가정보호사건의 대상이 되는 가정폭력범죄에 포함되는지 여부를 판단하였다. 결론 및 제언: 노인 폭행 또는 상해 금지금정 위반으로 인한 노인복지법 위반죄는 가정폭력처벌법에서의 다른 법률에 따라 가중처벌되는 죄로서 가정보호사건의 대상이 되는 가정폭력범죄에 포함된다. 본 연구는 지금까지 법률에 명확하게 규정되어 있지 않은 노인복지법과 가정폭력처벌법의 관계를 명시적으로 제시한 판결을 처음으로 분석하였고, 학대유형 재구성과 (재)학대 발생에 따른 사후관리 등을 포함하는 입법 방향 및 입법 기술적 측면을 제시했다는 점에서 연구 의의가 있다.
This study analyzed the case law of a son’s assault on his elderly mother, reflecting the reality that elder abuse continues to occur in families. This study examined the application of criminal domestic violence to cases of elder abuse under the Elderly Welfare Act. In this case, the crime of violating the Elderly Welfare Act by assaulting an elderly person is included in criminal domestic violence that is subject to home protection cases as a crime that is aggravated by other laws in the Domestic Violence Punishment Act. This study analyzes for the first time a judgment that explicitly suggests the relationship between the Elderly Welfare Act and the Domestic Violence Punishment Act, which is not clearly defined in the law. This study is significant that it provides basic data necessary to raise awareness of elder abuse in the home and ensure the safety of the elderly.
