The Anti-North Korea Leaflet Law is a partial amendment to the ‘Development of Inter-Korean Relations Act’. The contents are as follows. If any person attempts to send leaflets to the North by balloon or floating plastic bottles, they can be imprisoned for up to 3 years or be fined up to 30 million won. The law bans and criminalizes the sending of propaganda leaflets into the North. It was promulgated on March 30, 2021. However, some groups have expressed their intention to continue the leaflet campaign, giving notice of a large-scale send-off of leaflets towards North Korea even though it might violate the law of South Korea. They asserted that anti-North Korea leaflets could be helpful for fulfilling North Korean residents' right to know and for improvement the human rights situation. However, anti-North Korea leaflet campaigns have raised military tensions along the Military Demarcation Line. Also the people living in border towns have experienced threats to their right to life and livelihood and are suffering an economic crisis. This study analyzed the enactment process of the Anti-North Korea Leaflet Law. Interests, ideas and institutions were identified as determining factors, while the causal mechanism for the enactment process of the Anti-North Korea Leaflet Law was determined through theoretical discussion on causality and causal mechanisms and through explanations about the form of the hypothesis. The causal mechanisms were analyzed using the process tracing method, which is used in the social sciences for tracing causal mechanisms.As a result of the analysis, this study was able to reveal that interests and ideas have a causal relationship with the enactment process of the Anti-North Korea Leaflet Law. The President's security consciousness was identified as a particularly key factor in the establishment of the law. From this study, proposals are offered for effecting the unwavering implementation of the Anti-North Korea Leaflet Law in order to protect the safety of residents near the DMZ and to advance inter-Korean relations and peace and prosperity on the Korean Peninsula. The necessary conditions for achieving this are also considered.
대북전단살포금지법은 대북전단 살포 행위 등 남북합의서를 위반하는 행위를 할 경우 3년 이하의 징역이나 3천만 원 이하의 벌금에 처할 수 있도록 하는 것을 주요 골자로 하는 「남북관계 발전에 관한 법률」의 일부 개정안이다. 2020년 12월 29일에 공포되고, 2021년 3월 30일부터 시행되고 있으나, 대북전단 살포 단체는 실정법 위반을 감수하면서까지 북한 주민들의 알 권리 충족과 인권 개선을 명목으로 대북전단 살포에 나서고 있다. 이에 따라 북한의 군사도발 가능성은 계속되고 있고, 접경 지역 주민들은 생존권 및 경제적 위기를 겪고 있다. 본 연구는 대북전단살포금지법의 입법 과정에 관한 연구를 진행했다. 제도 결정요인으로 이해관계, 아이디어, 제도, 그리고 인과성과 인과 메커니즘에 대한 이론적 논의, 그리고 가설의 유형에 대한 설명을 기반으로 대북전단살포금지법 입법 과정의 인과 메커니즘에 대한 가설을 설정하고, 가설을 검증하기 위해 사회과학 분야에서 인과 메커니즘 분석방법으로 주목받고 있는 과정추적법을 도입하였다. 분석 결과 이해관계와 아이디어가 대북전단살포금지법 입법에 직접적인 인과관계가 있는 것으로 나타났고, 그중에서도 대통령의 안보 의식인 아이디어가 핵심적인 역할을 하는 것으로 분석되었다. 본 연구를 통해 대북전단살포금지법이 접경지역 주민들의 생존권과 남북관계 발전 그리고 한반도 평화를 위해 흔들림 없이 시행될 방안을 제안하고, 이를 위해 조성되어야 할 여건은 무엇인지 고찰하였다.
