El presente artículo aborda la normativa legal donde se analiza la forma de ejecución de la reparación integral en materia penal, verificando que su falta de eficacia incide directamente en la tutela efectiva de los derechos de la víctima. Para esto es de importancia comprender a la luz de la justicia restaurativa, como es que la reparación del daño históricamente ha ido actualizándose hasta llegar a la concepción actual que es la que se encuentra acuñada en el marco del Código Orgánico Integral Penal, la cuál ha sido acogida desde los pensamientos de la Corte Interamericana de Derechos Humanos hasta arribar a la normativa nacional, pero que en principio se ha buscado dotarle de un marco sustantivo a la reparación del daño causado a consecuencia de los efectos irradiantes de un delito, encontrando interés de estudio en el marco adjetivo penal y el cumplimiento de mecanismos reparadores. En la investigación se utilizaron métodos y técnicas teóricas, empíricas y matemáticas estadísticas, todos en correspondencia con el objetivo del estudio que se orientó hacia: aplicar una escala lingüística neutrosófica para la valoración de la ejecución de la reparación integral en el derecho adjetivo penal ecuatoriano. Los resultados obtenidos son importantes para realizar investigaciones de mayor grado de profundidad. Palabras clave: neutrosofía, reparación integral, justicia restaurativa, víctima This article addresses the legal regulations where the form of execution of the integral reparation in criminal matters is analyzed, verifying that its lack of effectiveness has a direct impact on the effective protection of the victim's rights. For this it is important to understand in the light of restorative justice, how the reparation of the damage has been historically updated until reaching the current conception which is the one coined in the framework of the Organic Integral Penal Code, which has been accepted from the thoughts of the Inter-American Court of Human Rights until arriving at the national regulations, but which in principle has sought to provide a substantive framework for the reparation of the damage caused as a result of the radiating effects of a crime, finding interest of study in the penal adjective framework and the fulfillment of reparative mechanisms. The research used theoretical, empirical and statistical mathematical methods and techniques, all in correspondence with the objective of the study which was oriented towards: applying a neutrosophic linguistic scale for the valuation of the execution of the integral reparation in the Ecuadorian adjective penal law.
