Abstract
This article describes the origin and operation of current Latin American secured transactions law and the principal features of the Organization of American States (OAS)-sponsored Model Inter-American Law on Secured Transactions. The article first outlines the evolution of security interests in the United States and Latin America focusing on the security devices provided by each legal framework. Next, the article describes reform efforts within the OAS and Mexico discussing the legal principles upon which these efforts are based. The major part of the article explores specific features of the Model Law, contrasting them with those of the current legal framework. The conclusion tallies the shortcomings of current law against the benefits of the Model Law.
