Abstract
Sexual violence against children is a crime that is dealt with seriously in the world in that is directed against children who are socially disadvantaged and that the damage affects the victim over a long period of time. Thus, compared to other crimes, many systems and procedures have been studied in terms of victim protection rather than punishment of perpetrators, and the nation has also improved laws and systems in this direction. In order to ensure that victims of child sexual violence are not subject to secondary damage due to minimal exposure in criminal procedures, and at the same time, the video recoding system and a trust-related statement support system were newly established to enhance the credibility of the statements. Along with the revision of the law, the police also established a new department dedicated to child sexual violence and made efforts to minimize secondary damage and foster professional investigation personnel during the investigation process. However, we still need to be careful about how we deal with child sexual violence throughout the criminal process from a victim’s perspective. It is necessary to develop and distribute manuals and animations on sexual violence prevention and intervention. In addition, the government should strengthen its intervention in sexual violence against disabled children and teenagers and strengthen preventive monitoring of CCTV. It is necessary to develop systematic child sexual violence prevention programs and expand education time and educational materials to prevent prostitution and sexual abuse. And Measures to minimize secondary damage to victims due to repeated investigations and reinforcements are also required and it is also necessary to strengthen training and education of experts in court-related personnel. Our investigators, court’s legislative body should understand more accurately the flow of discussions and concerns related to the protection system of child sexual violence victims at the level of advanced countries. And we need to think more about how children should be involved in criminal proceedings in what environment to find the real truth, guarantee their rights to defense, and implement specific policies to effectively harmonize the values of protecting their human rights with the principles of the existing law.
