Abstract
This study was conducted to find ways for the police to use drones in assembly & demonstrations. The research method was compared and analyzed with foreign institutions based on literature research. The cases of the United States, the United Kingdom, France, and Germany were reviewed to explore the grounds and consideration factors for using drones for assembly and demonstrations in Korea. As a result of the study, it was analyzed that in order for the police to use drones for assembly and demonstrations under the current system, legal grounds must be established, and drones can be used at assembly sites only when problems such as privacy and personal information infringement are solved. In particular, the United States, France, the United Kingdom, and Germany have prepared and operated laws to use drones or are already using drones at assembly sites based on precedents, and are expanding their use by clarifying legal grounds. It suggested weak legal grounds for drone use, concerns over personal information infringement, special provisions of the Aviation Safety Act, compensation and responsibility in the event of an accident, lack of overseas case review. In conclusion, in order for the police to use drones in assembly sites and rally demonstrations, legal grounds were prepared by revising the Police Unmanned Flying Device Operation Rules and Act on the Execution of Duties by Police Officers Act, and at the same time, it was suggested to purchase and utilize various types of drones. It is clear that safety measures to save multiple lives are more important values than the legal interests of individuals' information protection. It is hoped that this study will serve as basic data for the use of drones in assembly and demonstrations to guarantee the right of assembly and demonstrations, guarantee basic rights of individuals, and ensure safe and fair law enforcement, and various follow-up studies will continue.
