Abstract
The article discusses the tensions of mental disability law in the mental health courts. It examines the impact of social oppression and pathology to the relationship between criminal and civil mental disability law. It also cites the conceptualization and legal articulation of the right of the individuals to refuse treatment in criminal and civil settings.
