Abstract
The article focuses on the personal-jurisdiction requirement in New York Convention proceedings. Personal jurisdiction being assumed to be always required rather than being necessary as a matter of due process is presented in decisions by U.S. courts in cases such as Frontera Res. Azer. Corp. v. State Oil Co. of Azerbaijan. The lack of a clear due-process rationale for the jurisdictional requirement is discussed as hampering the enforcement of a foreign award in the U.S.
