Abstract
Reproduces a discussion paper on trial by jury, drafted for the International Society for the Reform of Criminal Law. Discusses the principal justification of having trial by jury and examines its difficulties. Evaluates whether a jury trial is an appropriate method of administering criminal justice and ensuring that the accused receives a fair trial. Analyses which mode of trial is more independent by comparing a jury trial with other existing or proposed modes of trial including trial by independent tribunals, by judge alone or by professional or special jurors and assessors.
